International Trade and Tariffs: Growing Chinese Business and Trade in North America and Globally through Canada

With all the recent trade and protectionist rhetoric and actions in the US, the best way to advance Chinese business and trade for the United States,  Canada and globally may be through Canadian business entities and platforms.

Canada still is within North American Free Trade Agreement (NAFTA) with the United States and Mexico, which is the largest free-trade region in the world. Canada is also the United States’ largest trading partner, and for these two reasons is likely to be exempt from global US tariffs for steel and aluminum.

While the US has some of the most protectionist trade measures and policies in the world, Canada has the least. The United States, in particular, is challenging and reviewing many intellectual property investments by Chinese-based companies.

Canada is committed to the World Trading Organization and rule-based regimes for international business and trade, on December 20, 2017, launching significant challenges to US practices under DS535 United States- Certain Systematic Trade Remedies Measures.

Canada is also party to over free trade agreements with over forty countries in  Europe, Asia and Latin America including the Comprehensive Economic and Trade Agreement (CETA) with the European Union, the twelve-nation Trans-Pacific Partnership (TTP), and the free agreement with South Korea.

Therefore Canadian based businesses have an advantage, and can also readily own and operate US businesses. Depending on where a business is incorporated in Canada, there may not be any Canadian residency requirement for shareholders

Canada has innovative technology companies and good intellectual property regimes, with a comprehensive intellectual property strategy currently being developed. Some areas such as online sales and e-commerce are still relatively loosely regulated under NAFTA, allowing US sales from Canadian-based businesses.Come speak to us at Alpine Law and explore the Chinese – US – Canada business and trade opportunities.
